UNPROFESSIONAL, DECEITFUL AND MAY RIP YOU OFF! Dr. Gary Herskovits, Dr. Amy Herskovits and Dr. Lloyd Soman of Brooklyn Smile (Gentle Dental) FACT: Gary Herskovits was fined by New York State $5,000 and placed on 1 year probation, admitting to erroneous charges he billed to both a patient and filed with an insurance company. (http://www.op.nysed.gov/opd/feb97.htm). It seems his corruption continues. It’s currently happening to me. I made an appointment with an ‘In Network’ periodontist (Soman) who recommended a root scaling/planing, a cleaning procedure. They say my insurance didn’t cover this procedure (which I later found they cover 50%) and charged me $600. Moments later, Soman entered with someone, introduces her as Amy Herskovits, and said she‘d perform the cleaning. Weeks later, both Soman and Amy Herskovits filed separate insurance claims, one for ‘In Network’ and one for an ‘Out of Network’. After explaining the situation to insurance (UHC), they said claim filed were incorrect. Also this goes against the ‘Surprise Bill’ law. UHC told me either the provider could send a ‘corrected’ claim’or I can appeal the existing erroneous claim. I called Brooklyn Smile. When I explained, the receptionist interrupted stating she remembered me and my insurance initially gave her the wrong information. I said that’s possible but whomever made the mistake, an error occurred, and a corrected claim needs to be filed. Gary Herskovits abruptly joined the call and said the claim form was filed correctly and since Amy did the procedure, she filed the claim. After many attempts to speak and being interrupted, I had to ask Gary to stop interrupting me and please allow me to explain. 1. I didn’t make the appointment with Amy and wasn’t made aware that she was an ‘Out of Network’ dentist (which I found out later is illegal ‘The Surprise Bill’ law) 2. I’m covered 50% for the procedure 3. Until resolved, as it’s no fault of mine, to reverse $600 overpayment He refused, accused UHC of wrongdoing, and the claim filed is correct. This is between the the provider and insurance, not me, Gary H. said since it’s my insurance, I should have UHC call him. Months following, UHC reached out but Brooklyn Smile and Herskovits would ignore calls, place on hold, drop the call, etc. one UHC rep said they told her to stop calling. Gary H. and his team never cooperated. Since then, after appealing their claim, it was overturned given the erroneous claim. UHC relayed their findings to both Gary H. and myself, which we are both awarded money; however, since only one check can be sent, it must go to the provider. I questioned why send this provider, who displayed deceitful acts, money I’m owed. UHC apologized, saying the provider agreed to pay me my portion. After explaining my reservations on getting my money, they said there’s nothing they could do, and they provided me with proof in correspondence. I reached out to Brooklyn Smile for the status on receipt of the check and included a copy of UHC’s correspondence to remind him of the conversation. I received a response stating non receipt, didn’t agree with the amount and to have UHC call them (because I’m apparently Gary H. 's secretary instead of customer). So I decided to wait/see if the check from UHC ever got cashed, which it was, in late October (no surprise). I called UHC and told them provider didn’t pay me what they paid/I was owed. UHC attempted to intervene, and again their calls were ignored. I sent Brooklyn Smile an email stating to pay me monies from the cashed check. They decline yet offered me hundreds less, basically stealing money from me. I demanded they pay me the monies owed to me or I will have no choice to sue in small claims court. Their reply was, “ok see u there”. I’m now filing a lawsuit against this practice and all involved. It’s not for the money, but for it to be made aware by others of the corruption that is being done. These unethica facilities should not be in practice, nomatter what level the work is! They scammed me and my insurance company and it’s not the first and last! Herskovits and his facility should/will be investigated further with the AMA, the city and state, NYC/NYS. This is also being posted on many other websites to warn you all about this deception. All should be made aware as it’s not as isolated situation (they made a law about it, the Surprise Bill. Please share this review with everyone. These types of healthcare ‘professionals’ are only interested in money, not the well-being of their patients and need to be stopped!
